French philosopher Albert Camus wrote that "capital punishment is the most premeditated of murders". "The United States' concept of justifiable homicide/Executions in criminal law stands on the dividing line between an excuse, justification and an exculpation. In other words, it takes a case that would otherwise have been a murder or another crime representing intentional killing, and either excuses or justifies the individual accused from all criminal liability or treats the accused differently from other intentional killers.

The President rebuffed; Mexican executed

Flatly refusing to take the President’s word on a foreign policy issue, the Court by a 5-4 vote allows Texas to execute a Mexican national even though his international treaty rights had been violated.
UPDATE 8:30 p.m. About an hour after the Court ruled, Texas executed Humberto Leal Garcia.

Refusing to defer to President Obama’s view of a threat to U.S. foreign relations, the Supreme Court voted 5-4 late Thursday afternoon to allow Texas to execute a Mexican national whose international treaty rights were violated in his prosecution for murder. The Court majority dismissed as “free-ranging assertions” the President’s foreign policy arguments against the immediate execution of Humberto Leal Garcia, and added that the Obama Administrration had not presented “a persuasive legal claim.” (The ruling and the dissent are here.)

This appeared to be a more serious rebuff of the President’s powers as the nation’s diplomat-in-chief than the one the Court had issued three years ago, in another Mexican national’s death penalty case, during the George W. Bush Administration. Then, the Court said a treaty that President Bush had invoked — the Vienna Convention — was not binding law in the U.S. This time, however, the Court majority went further, and simply would not take the President’s word on “foreign policy consequences” expressed directly to the Court, were Leal Garcia to be put to death......

                Hello, my name is Humberto Leal Jr., my TDC-ID is 999162. I am a death row prisoner. I have been on death row for 11 yrs.

I am a Mexican Born in Monterrey, Mexico in 1973.

I have been living in the USA since I was about 3 yrs. old.

I speak and understand both English and Spanish well.

I would like to hear from anyone willing to write me. It don't matter to me who, if its male, female young or older. I am honest. I like to write and receive mail.

                 My hobbies are listing to football and baseball games. I'll go shot few baskettball at the rec., but other than that I've learned to enjoy reading.

                 When I was free I never read a book. But finding myself here in a boring cell I started to read and can't go a week without reading a book.

                Hallo, mein Name ist Humberto Leal Jr., meine Todestraktnummer ist 999162. Ich bin ein Todestrakthäftling. Ich bin seit 11 Jahren im Todestrakt.

Ich wurde 1973 in Monterrey, Mexico geboren und lebe in den Vereinigten Staaten seit ich 3 Jahre alt bin. Ich spreche und verstehe sowohl Englisch als auch Spanisch gut.
Ich möchte gerne von jedem hören, der mir gerne schreiben möchte. Es ist mir egal ob Mann oder Frau, alt oder jung. Ich bin ehrlich. Ich schreibe und erhalte gerne Briefe/Post. 
Meine Hobbies sind Football- und Baseballspiele im Radio zu hören. Manchmal werfe ich ein paar Basketbälle im Gym aber sonst habe ich gelernt, Freude am Lesen zu haben.
Als ich frei war, habe ich nicht ein Buch gelesen. Aber seit ich in dieser Tristes lebe, geht keine Woche vorbei, in der ich nicht wenigstens ein Buch lese.
